PETITIONER’S MOTION TO CORRECT ERROR

                Comes Now Petitioner, Mmoja Ajabu, pro se, and pursuant to Federal Trial Rule 60, moves this Court to the correct error it made in granting Heather Harvey, (“Harvey”) a protective order.  In support of this Motion, Respondent states the following:

1. 4.       On January 3, 2018 Respondent, Heather Harvey, filed for a Protection Order against Ajabu in            Court Room 16.

1. 5.       On the same day, January 3, 2018 Judicial Officer Angela Dow Davis set hearing for January                25, 2018 at 1pm to hear Harvey’s accusation against Ajabu.

1. 6.       On February 2, 2018 Ajabu filed word for word the same petition that Harvey filed and that                was assigned to Superior Court 16. The only difference in the petitions was now Ajabu was                   seeking the protective order against Harvey.

1. 7.       Ajabu’s petition was assigned to Marion Superior Court 17.

1. 8.       On February 6, 2018 Magistrate Ms. Marshelle Broadwell denied Ajabu’s petition.

1. 9.       Heather Harvey is a white woman.

1. 10.   Mmoja Ajabu is a man of African descent.

1. 11.   Harvey represents Congressman Andre Carson and is his veteran’s representative.

1. 12.   Ajabu represents the Vietnam Veterans of America and is our Agent Orange Advocate.

1. 13.   On December 19, 2017, Mayor Joe Hogsette’s office held a city wide veteran’s meeting at the Sheraton Inn located at 21^st and Shadeland.

1. 14.   Both Harvey and Ajabu attended this meeting.

1. 15.   After the meeting Ajabu requested Harvey to come to the side so he could discreetly ask if Congress had paid any woman accuser for Congressman Carson acting sexually inappropriately towards them. Ajabu did not want to ask such a sensitive question in open forum although the meeting was completed.

1. 16.   When Ajabu asked Harvey the question she erupted and stormed back in the meeting stating very loudly “Get Him Away From Me”. She stated this phrase several times.

1. 17.   Ajabu informed Captain Jason Lee Straw USAF, Nurse Corp (Retired) (“Straw”) that I could not let Harvey go into the room making that statement because someone might conclude that I had mistreated her. I am very well aware of what happened to Emmett Till in Money Mississippi. A white woman’s false accusation caused Emmett to lose his life.

1. 18.   I went back into the room and stated the following: “No Get Her Away From Me.” She cussed me and acted very inappropriately as a representative for Andre Carson, who is my representative.

1. 19.   Due to this interaction Harvey’s petition falsely accuses Ajabu of stalking her.

1. 20.   Straw, the only other person present outside the room when this interaction occurred, has provided a signed statement, which is included with this motion, which clearly states the following: “While I was at the meeting I saw no Misconduct that came to my attention inside the room or immediately outside around the tables. . .Rev. Ajabu brought to my attention that he was being accused of stalking someone at a public meeting. I found this odd since the meeting is open to all. He asked me to write this letter to affirm what I witnessed.”

1. 21.   Harvey falsely accuses Ajabu of stalking and is granted a hearing on the same day.

1. 22.   Ajabu used Harvey’s exact words to file a petition and is denied a hearing. The court’s ruling shows that a white woman’s false words are more believable to the court than the truthful word of a man of African descent. The court’s error shows justice is not blind if race is involved, especially if the accuser is a white woman and the accused is a man of African descent.

WHEREFORE, Ajabu requests this Court correct its error in granting Harvey’s application for a protective order and requests this Court to order all remedies just in the premise.
